TERMS OF PARTICIPATION for the “Mate10 Pro Upgrade Programme” promotional campaign by HUAWEI Technologies Duesseldorf GmbH

The “Mate10 Pro Upgrade Programme” promotional campaign (hereinafter referred to as “promotional campaign”) is staged by HUAWEI Technologies Duesseldorf GmbH, Hansaallee 205, 40549

Düsseldorf, Germany (hereinafter referred to as “HUAWEI”).

The promotional campaign is handled through Teqcycle Solutions GmbH (hereinafter referred to as “Teqcycle”)


  1. Private customers who are resident in the UK (hereinafter referred to as “participant(s)”) and who purchase the HUAWEI smartphone models stated in section 3 in the period from 18 December 2017 to 4 February 2018 (“promotion period”) in the UK are eligible to participate. Employees of HUAWEI and the agencies involved in the promotional campaign and their family members are not allowed to take part. The promotional offer does not apply to devices that have been acquired from private sellers or in online auctions. The date of invoicing and, in the case of online purchases, the date the order was accepted shall be authoritative. A maximum of one promotional device per person and a maximum of two promotional devices per household can be registered. The promotional campaign cannot be combined with other promotions, vouchers, allowances, rebates or discount campaigns of HUAWEI.
  2. Participation in the promotional campaign is free of charge.
  3. The following smartphone models will take part in this promotional campaign: HUAWEI Mate10 Pro (hereinafter referred to as “promotional smartphone” or “promotional device”).
  4. HUAWEI will issue a voucher for £40 (hereinafter referred to as “campaign voucher”) for promotional smartphones of the models specified in section 2 purchased in accordance with the terms of participation in the UK in the promotion period.

  6. In order to take part in this promotional campaign, you must purchase a promotional device and register it at 
http://consumer.huawei.com/uk/campaign/mate10-pro-upgrade. After registering, you will receive an e-mail confirming your participation.
  7. You can register at http://consumer.huawei.com/uk/campaign/mate10-pro-upgrade 45 days after your purchase (between 01 February 2018 and 31 March 2018, limitation period) and claim your gift code. When registering, you must state your name, address, e-mail address and the IMEI number. You must also upload a photo of the original packaging with a visible sticker showing the IMEI number and a photo on which the sales receipt and the promotional smartphone can be seen. The photos must contain a data stamp proving that the photo was taken at least 45 days after the promotional smartphone being purchased.
  8. Persons who have registered and are eligible to take part in accordance with the terms of participation will (usually) be sent the campaign voucher by e-mail to the e-mail address they have stated within 30 business days of registering. If the campaign voucher cannot be delivered, any entitlement to it shall be forfeited. There may be delays in sending the voucher if demand is unexpectedly high.
  9. If not all the documents have been submitted on time or in full within the registration period, any entitlement to the campaign voucher shall be forfeited. With the confirmation mail sent to notify participants that all the data has been verified successfully, HUAWEI undertakes to provide the participant with a campaign voucher in accordance with the terms of participation.

  11. Persons whose particulars are not complete and/or whose receipts/documents are incorrect or not submitted will be notified by e-mail and requested to furnish the missing data within the limitation period. If all the data is not provided within the limitation period, HUAWEI may exclude the participant from the promotional campaign.
  12. Participants are obliged to provide the original sales receipts at the request of HUAWEI. They will then be returned to the participant.

  14. HUAWEI shall not accept any liability within the statutory limits for damage and loss or deletion of data resulting from technical faults, viruses or other delays.
  15. HUAWEI shall be liable in accordance with statutory regulations if claims for damages are asserted due to wilful intent or gross negligence. If HUAWEI is not guilty of an intentional breach of contract, liability for damages shall be limited to foreseeable damage that typically occurs. HUAWEI shall be liable in accordance with statutory regulations if it culpably violates a cardinal contractual obligation: however, liability for damages in this case shall likewise be limited to foreseeable damage that typically occurs. Liability due to injury to life, body or health for which HUAWEI is to blame shall remain unaffected; this shall also apply if there is compulsory liability under product liability law. Any liability for damage above and beyond that shall be excluded, without regard to the legal nature of the claim. If liability for damages on the part of HUAWEI is excluded or limited, this shall also apply to the personal liability for damages of its employees, representatives and vicarious agents.
  16. HUAWEI shall not accept any liability for any free gifts or extras provided as part of the promotional campaign, shall not warrant that they are free of defects and shall not be liable for damage occurring as a result of their use or utilisation. HUAWEI shall not accept any liability if the contest is interrupted or cannot be accessed due to technical faults and outages.

  18. HUAWEI and Teqcycle will store and process the stated personal data (surname, first name, address, e-mail address, IMEI number, sales receipt) only for staging the promotional campaign. Participates can withdraw from the promotional campaign by sending an e-mail with the subject “HUAWEI Stop” to the e-mail address mobile.uk@huawei.com. HUAWEI and Teqcycle will delete the personal data it is provided with to stage the promotional campaign when it is no longer needed.

  20. By registering, the participant acknowledges these terms of participation.
  21. Participants shall not have any right to return or exchange the voucher. No cash payments shall be made in lieu of the voucher.
  22. HUAWEI can terminate the promotional campaign prematurely and amend the terms of participation at short notice. In particular, HUAWEI reserves the right to terminate the promotional campaign prematurely in the event of force majeure or unexpectedly high demand for participation in the promotional campaign. The participant shall be given immediate notification of any amendment to the terms of participation by e-mail and shall also be given a reasonable period of time in which to be able to object to the new terms of participation. The amended terms of participation shall be deemed to have been approved if the participant does not object to them within said period of time. HUAWEI shall point this out to the participant in the notification.
  23. The applicable law of the UK shall apply exclusively. Mandatory consumer protection provisions of the country where the participant has his or her habitual residence shall remain unaffected. Any disputes shall be settled before a competent court of law in England (where legally permissible). Decisions by the promotional campaign’s organiser are final.
