Terms and Conditions of the Huawei Points Program

The Huawei Points Program (the "Program") is a loyalty program promoted by Huawei Technologies (Malaysia) Sdn. Bhd., a company incorporated under the law of Malaysia, having its registered office at Suite 34-01, Level 34, Integra Tower, the Intermark,348, Jalan Tun Razak, 55000 Kuala Lumpur, Malaysia under registration number 200101010193 (545949-D) (the “Promoter”). Individuals who have a valid HUAWEI ID (a "Participant"), may earn points ("Points") via official Huawei channels, namely the My HUAWEI app, the official Huawei website as well as the following selected physical HUAWEI Experience Stores (HES) (collectively “Official Huawei Channels):

(i) Huawei Authorized Experience Store (Taiping Sentral Mall)
(ii) Huawei Authorized Experience Store (Eko Cheras)
(iii) Huawei Authorized Experience Store (TRX)

Users who have registered and logged in with a HUAWEI ID may earn Points from making purchases, and use them to get discounts when buying HUAWEI products from the My HUAWEI app and the official Huawei website (“Official Online Channels”). Usage of the Points for purchases made at the HES is currently unsupported.

The gained Points will be credited to your User Center and the used Points will be deducted accordingly as set forth herein.
By taking part in the Program, the participant accepts these terms and conditions:

1. Eligibility and Participation in the Program

1.1 The Program is open to Malaysia legal residents who are eighteen (18) years of age or older.

1.2 The participant needs to have a valid HUAWEI ID account registered via Official Huawei Channels and log in to the account. Guests cannot use this feature. Such accounts are free, but are subject to the Terms & Conditions.

1.3 The Program is provided to consumers only. Companies, associations, including school organizations, or other groups MAY NOT participate in the Program. Corporate purchase orders cannot generate and use Points under this Program.

1.4 Continued participation by a Participant in the Program constitutes the Participant's continued full and unconditional agreement to these Program Terms and Conditions, as they may be updated from time to time ("Rules"), and representation that the Participant meets the eligibility requirements set out in these Rules. Those who do not comply with these Rules may be disallowed from participating in the Program as determined by the Promoter in its sole discretion. There is a limit of one (1) User Center per person/e-mail address, regardless of whether more than one person uses the same e-mail address. The person who is the authorized e-mail account holder of the e-mail address indicated when registering (and who otherwise meets the eligibility criteria) will be deemed the Participant.

2. Modification and Termination of the Program

The Promoter also reserves the right to modify, suspend, or terminate the Program at its discretion, at any time with notice.

3. Earning Points

Earn Points by making purchases through Official Huawei Channels for the Malaysia region: You may earn Points by purchasing HUAWEI products through Official Huawei Channels while logged in to your HUAWEI ID. No Points are given for consignment goods, virtual goods, and enterprise-purchased goods. For other applicable scenarios, the number of Points will be calculated based on the following rules:

(i) Points quantity=100% of the amount actually paid excluding freight fee. In the calculation result, any number after a decimal point will be rounded off.

(ii) The final Points quantity will be calculated after all discounts, coupons, and promo codes have been redeemed and will not include shipping or taxes or other fees, if any. The number of Points that will be earned will be displayed after checkout/payment/order completion.

(iii) Points will be credited to the Participant's HUAWEI ID once the corresponding order is completed and payment has been made by Participant. .

4. Point Value, Transferability, & Viewing

4.1 No Cash Value or Transferability

Points do not constitute property, do not entitle a member to a vested right or interest, and have no cash value. As such, Points are not redeemable for cash or transferable or assignable for any reason. Accordingly, Points are not transferable (a) upon death, (b) as part of a domestic relations matter, (c) across separate User Centers held by one Participant, or (d) otherwise by operation of law. The sale or transfer of Points is strictly prohibited. Points may not be sold on any secondary market, and any transfer of Points to a secondary market shall be deemed void. There shall be no carryover or transfer of Points to other Promoter programs, unless otherwise determined by the Promoter in its sole and absolute discretion.

4.2 Points Expiration

Points are valid until December 31st of the second year after you receive them. You can see how many Points are expiring soon in the User Center > Points menu. Once expired, Points cannot be used, and this will be reflected in your number of Points.

4.3 Accrued Points Viewable in the Participant's User Center

The number of Points collected by each Participant will be tracked in the User Center. The Points will be credited to the Participant's User Center after

(i) transaction confirmation;

Any claim for Points not credited accurately must be received by the Promoter within 30 days of the date of claimed accrual of such Points.

Manual issuance of Points can take up to 30 days.

The Promoter reserves the right to invalidate Points from a Participant’s User Center if it determines that such Points have been improperly credited or fraudulently obtained. The Promoter reserves the right to require proof of accrual of Points and to delay the processing or redemption of any Points without notice to Participants in order to assure compliance with these Rules. Participants are responsible for maintaining the confidentiality of their Participant User Centers and passwords and for restricting access to their devices and activities on their Participant User Centers, and Participants agree to accept responsibility for all activities that occur under their User Centers. Without limiting any other remedies, the Promoter may suspend or terminate a Participant's reward account if the Promoter suspects that the Participant has engaged in fraudulent activities in connection with the Program.

Participation in the Program is subject to these Rules, as well as policies and procedures that the Promoter may adopt or modify from time to time. Any failure to abide by these Rules or any policies or procedures implemented by the Promoter, any conduct detrimental to the Promoter, or any misrepresentation or fraudulent activities in connection with the Program may result, in addition to any rights or remedies available to the Promoter in law or equity, in the termination of participation in the Program, as well as forfeiture of Points accrued to date, all as determined by the Promoter in its sole discretion.

5. Redeeming Points Earned

5.1 Points can be used to gain specific discounts (rule: 1 MYR can be deducted with every 100 Points) when making a purchase through an Official Online Channel for the Malaysia region. Whether an order is eligible to receive any discount with Points is subject to the actual information displayed on the page. Points cannot be used to pay for an entire order, and the deductible amount will be shown in the order summary if the Participant chooses to use the Points by clicking the "Redeem" button. When you choose to use Points, the deductible Points cannot exceed 20% of the total actual payment amount of the goods that are eligible for the deduction in the order.

5.2 Currently, usage of Points is not supported for flash purchase, premium purchase code offering, preferential purchase offering, enterprise purchase offering, consignment sale offering, and purchase of virtual goods.

5.3 Once an order is submitted with Points used, the number of used Points cannot be changed. If you need to modify the order, you may cancel it within the cancellation time permitted by the system, and submit the order again. If the order is successfully cancelled, the Points will be returned to the account within a specified period.

5.4 Points cannot be redeemed and cannot be used across accounts. You can only use Points for your own orders, and Points are non-transferable. In addition, invoices are not issued for the Points deducted and the Points deducted are separately listed on the invoice as sales discount lines.

5.5 The Promoter reserves the right to modify the list of discounts available, as well as Point values corresponding to them, at any time for any reason.

6. Additional Conditions

6.1 The Promoter reserves the right to suspend or discontinue the eligibility of any person who uses, or, in the case of suspension, is suspected of using, the Program in a manner inconsistent with these Rules or any local laws. In addition to suspension or discontinuance of the Program eligibility, the Promoter shall have the right to take appropriate administrative and/or legal action, including criminal prosecution, as it deems necessary in its sole discretion.

6.2 Any attempt by any person to undermine the legitimate operation of the Program may be a violation of criminal and/or civil law, and, should such an attempt be made, the Promoter reserves the right to seek damages from any such person to the fullest extent permitted by law. The Promoter's failure to enforce any of these Rules shall not constitute a waiver of that, or any other, provision.

6.3 This Program and the Terms and Conditions herein shall be governed by and interpreted in accordance with the laws of Malaysia. Nothing in these Terms shall exclude, limit, or restrict your rights under local mandatory consumer laws.

7. Limitation of Liability

7.1 The Promoter, and its parent, subsidiary, affiliate, franchisees, and related companies, and each of its and their respective officers, directors, employees, shareholders, agents and promotional and advertising agencies, successors, assigns (collectively the "Released Parties") are not responsible for any printing or computer error, omission, interruption, irregularity, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alteration of Program materials or for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions of any kind, or inaccurate transmission of Program information due to technical problems or traffic congestion on the internet, at any website or any combination thereof.

7.2 By participating in the Program, each Participant accepts all responsibility for, and hereby releases and agrees to indemnify and hold harmless the Promoter and its parent companies, subsidiaries, affiliates, agents, promotion and advertising agencies, including, franchisees, and each of their respective officers, directors, employees, shareholders, and successors, assigns, and service providers from and against any claims, liabilities, damages, or expenses that may arise from actions taken by such Participant and/or such Participant's participation in the Program, or for any harm or injury caused by any third party.
