Full Terms and Conditions
These Terms and Conditions (the “Terms and Conditions”) prevail in the event of any conflict or inconsistency with any other communications, including advertising or promotional materials. Entry instructions are deemed to form part of these Terms and Conditions and by participating all participants will be deemed to have accepted and be bound by them. Please retain a copy for your information.
The Promoter takes data protection seriously. By entering this competition, you confirm that you have read the Privacy Policy for the applicable platform and agree to these Terms and Conditions of the competition. By submitting any information required as part of their participation into the campaign, participants understand that their information will be held and processed in accordance with the General Data Protection Regulation (GDPR) or appropriate data protection laws.

Eligibility
The Huawei “togetherness” competition is open to all individuals who find out about it, excluding employees (and their immediate families) of Huawei, their affiliates, agencies, or anyone else professionally connected with the competition.
This competition is void where prohibited by local laws. It is the responsibility of the entrant to ensure the legality of entering this competition under the laws of their country of residence.
Entrants must be 18 years or over.
Internet access required. Entry is only valid via an active Instagram or Twitter account
If you do not have an Instagram or Twitter account you will need to create one in order to participate – you will require an active email address in order to do this.

Failure to comply with any part of these clauses will disqualify the respective entry from the promotion.
Competition Period
The competition opens on 23.12.19 at 00:00 (GMT-5 / UTC-5) and closes on 05.01.20 at 23:59 (GMT-5 / UTC-5).
Any entries received outside of these times and dates or deemed NOT to be of the relevant standard detailed below in the ‘content featuring’ section, will not be included in the competition.

You can find the competition on @HuaweiMobile’s Instagram or Twitter account. To enter this competition for an opportunity to win, you must visit:

Either log in from an existing Instagram member or sign up for free at Instagram.com as detailed above. To enter from a private account, you must amend your account settings to a public account in order for entry to be accepted. The account must remain public until the end of the fulfilment period of the competition in order to be contacted in the event your entry is a winning entry

There is a maximum of 1 entry post per channel. Therefore, a maximum of 2 entries are allowed per person. If two or more pictures are uploaded to the same channel, just the first uploaded picture in chronological order is allowed to enter the competition.
Your picture must be in JPEG, JPG, PNG and GIF format and be no bigger than 5MB.
Only new unique current valid pictures will be accepted. All entry information is subject to verification and interrogation to ensure it meets the acceptable standards. Any entries found to be copied, doctored or amended or plagiarized, will be disqualified.
Any submission containing the following content or suggesting innuendos of the following content will not be permitted and the entrant will be disqualified:
• Content which is distasteful, offensive, inappropriate or is of a sexual nature.
• Content for the intended purpose of harassing, threatening or embarrassing individuals or multiple individuals.
Content featuring:
• Individuals without the consent of all featured parties.
• Individuals smoking tobacco, drinking or appearing to be under the influence of alcohol.
• Any images which contain alcohol being handled, served or deemed socially irresponsible, being portrayed as a challenge or enhancing attractiveness, containing individuals who are or deemed to be under 18.
• The use, depiction or incitement to use drugs or any banned substances.
• Any images including visible trademarks, service marks, company names or other intellectual property rights other than Huawei.
• Political parties, political messages or demonstrations.
• Blasphemous or religious imagery or any image deemed to incite religious hatred.
• Potentially defamatory or otherwise actionable material.
• Any image which infringes any copyright, trademarks or other intellectual property rights of any third party.
• Third party promotional packaging, material or advertising.
• The depiction of the assembly of explosive materials, firearms or items deemed to be weapons of any nature.
• The depiction of individuals’ or companies’ names, phone numbers, email or postal addresses, or any other personal information deemed sensitive, private and/or unacceptable by the promoter.
• Any children under the age of 18 who are not family members or friends.
• Any Instagram or Twitter name or profile photograph which contravene the above will be void, and any entries will not count towards the competition
• Content sourced from commercial or third-party libraries (e.g. Getty Images, Google images etc).
• Contains any computer viruses, worms, Trojan horses or other potentially damaging computer programs or files
• Any content the Promoter in its sole discretion considers to be inappropriate to use.
By entering this competition, the entrant confirms that s/he has obtained any and all releases and consents of third parties necessary to permit the submission for the purposes of this competition and exhibition of the picture in the manner set forth in these terms and conditions without additional compensation
The Promoter reserves the right at its sole and absolute discretion to permanently disqualify from the competition any material that is deemed to be distasteful, degrading or will in any way cause offence and if necessary report or to disqualify any individual found to be attempting to circumvent the competition by tampering with the operation of the competition, setting up multiple accounts, using multiple identities, using rude, inappropriate, or profane statements or to be acting in any manner deemed by the Promoter to be in violation of the Terms and Conditions; or to be acting in any manner deemed by the Promoter to be disruptive.
The Promoter may forward any inappropriate content to the necessary authorities.
Anyone, who in the Promoter’s absolute discretion, is acting in a manner that undermines the operation and integrity of the competition or in any way that gives an unfair advantage, will be disqualified and any persons seeking to use such information gained will be disqualified.
All entries will be strictly monitored by the Promoter and their third-party adjudicators throughout and any attempts to manipulate or otherwise unfairly influence the results will result in disqualification of entry or suspension of the competition.
The Promoter does not guarantee that you will have any recourse to edit or delete any Content you have submitted. The Promoter has the right to remove or refuse to post any entry for any reason. You acknowledge that you, not the Promoter, are responsible for the Contents of your submission. None of the Content that you submit shall be subject to any obligation of confidence on the part of the Promoter, its agents, subsidiaries, affiliates, or third-party service providers and their respective directors, officers and employees.
Any bulk entries, entries from agents, third parties, syndicates, organized groups or entries automatically generated by a computer, programme, application, script or any automatic method will not be accepted. Any person or institutions trying to circumvent this condition by any method, including but not limited to using multiple or alias Instagram or Twitter accounts, will be disqualified along with all entries from associated accounts. Only genuine valid entries will be considered.
The person who has uploaded the picture is the individual who is entered into the competition.
The Prize

Prizes are strictly non-transferable and must not be sold, auctioned nor advertised for sale whether on the internet, in newspapers or elsewhere. Any person found in breach of this term will be disqualified from participating. No alternative prize will be available in whole or in part, except in the event of circumstances outside the reasonable control of the Promoter or Prize provider. The Prize Provider reserves the right to offer a suitable alternative of equal or greater value. Unless otherwise agreed in writing by the Promoter, the prize will only be awarded directly to the Winner.
The Promoter reserves the right to add more prizes into the main competition. Winners only will be notified in line with these Terms and Conditions.
Winning selection and notification
There will be a total of 20 winners.
All valid entries will be judged against the stated criteria by a panel of judges overseen by an independent third party during the competition and completed within 28 working days of the competition end date.
The judging panel will consist of a member from Huawei, a member from Grayling, and an independent Judge. All entries will be judged on merit based on the criteria of being the most:
• Creative - (created personally, one of a kind);
• Overall impression /impact – (the WOW factor without pushing the boundaries too far);
• Level of detail and composition (thought and skill in taking the photo) and the
• Marketability / relevance to” togetherness in the festive season” (Does this meet the brief – will it look and inspire people to view and appreciate the special place that friends or family have at this time of year?”.
The judging panel will score and subsequently rank all entries to find the top 20 winners. These top 20, and extras as potential reserves, will be independently verified and checked and will then be presented for confirmation that all is satisfactory and means the criteria set. In the event of a tie situation, the highest score from marketability / relevance to” togetherness in the festive season” (within the judging criteria will take precedence to determine the winner.
The winners will be notified within 28 days and the promoter will comment under the winner’s post on either their Twitter or Instagram post informing the consumer to direct message the promoter.
The Promoter will make reasonable efforts to contact the winners and then after successful contact, will subsequently communicate a secure downloadable link to allow potential winners to provide the Promoter securely with information including; their name, details and a valid home address as well as required documentation to assist with verification. Inaccurate information may result in the prize being forfeited. However, if a winner has not responded to notification within 14 days or if a selected winner is ineligible, otherwise in breach of these Terms and Conditions, or unable to take up the prize for any other reason, the Promoter reserves the right to withdraw the prize, and if time permits, re-allocate the prize back into the competition.
Once the verification stage has been completed and the winner has been marked as valid, details will then be given regarding the arranging and delivery of the prize, which should take place within 28 days of contact.
The Promoter is not responsible for any taxes, customs charges or other costs required for or related to receiving the prize.
The Promoter will further not compensate any prize that cannot be redeemed or received by a winner due to customs or other local regulations or that is damaged, delayed or lost by postal, courier or other mail service.
Winners are responsible for declaring and paying any applicable taxes and charges that may apply on the value of a prize awarded in the winner’s jurisdiction.
Montage
The Promoter reserves the right to use the contents of entries into the competition, for editorial, advertising, marketing and promotional purposes associated with the production of a one off “Togetherness at the festive period” video, without further compensation or notice, unless prohibited by law. Each Eligible entrant has the rights or use and grants permission for the Promoter to use any picture content of their entry for editorial, advertising, marketing and promotional purposes for this montage ONLY.
General Information
The Promoter reserves the right to verify all entries and the Winners and to refuse to award a prize or withdraw prize entitlement and/or refuse further participation in the competition and disqualify the participant where there are reasonable grounds to believe there has been a breach of these Terms and Conditions or any instructions forming part of this competitions entry requirements or otherwise where a participant has gained unfair advantage in participating in the competition or won using fraudulent means.
A list of Winners’ full names and their counties, provinces or regions, and a copy of the photo will be available on request by emailing Huawei.social@grayling.com within 3 months of the competition closing.
Winners only may be required to take part in reasonable publicity relating to this competition without further remuneration. Such publicity may include, without limitation, the entrants name and/or if consent given, image or statements made by the entrants concerning the promotion and/or prizes obtained as part of the promotion.
The contents of all the winning entries submitted become property of the Promoter. The Promoter reserves the right to use the contents of these winning entry submissions for editorial, advertising, marketing and promotional purposes, without further compensation or notice, unless prohibited by law. Each Eligible winning entrant grants permission for Promoter to use the contents of his/her entry submission for editorial, advertising, marketing and promotional purposes in any and all media now known or hereafter discovered, worldwide, in perpetuity, without compensation, notification or permission. Winning entrants agree not to assert any moral rights in relation to such use where the moral rights in respect of the content, are theirs to assert. Winning entrants, as all entrants warrant that the materials contain no copyright materials, are their original works, have not been copied, in whole or in part, from any third party and they have full authority to grant these rights.
No cash or other alternative gift available in whole or in part, except in the event of circumstances outside the reasonable control of the Promoter, the Promoter reserves the right to offer a suitable alternative of equal or greater value.
The Promoter's decision is final in all matters pertaining to the competition.
This competition is in no way sponsored, endorsed or administered by, or associated with Instagram or Twitter. Any information you provide as part of this competition is provided to the Promoter and not to Instagram or Twitter. Entrants to this competition hereby release Instagram or Twitter from any claim or liability suffered in connection with this competition.
In the event of circumstances outside the reasonable control of the Promoter, or otherwise where fraud, abuse, and/or an error (human or computer) affects or could affect the proper operation of this competition or the awarding of prizes, and only where circumstances make this unavoidable, the Promoter reserves the right to cancel or amend the competition or these Terms and Conditions , at any stage, but will always endeavour to minimize the effect to participants in order to avoid undue disappointment.
The Promoter may at its absolute discretion disqualify any participant found to be tampering with the application process or operation of the website or to be acting in any manner disruptive to the competition.
Sometimes, through reasons outside of the Promoters control, social media content may not be accessible. The Promoter cannot guarantee continuous, uninterrupted access to the internet, website or social media. No responsibility will be accepted for any difficulties in entering, claiming or any entries/claims delayed or corrupted. The Promoter will have no liability for any loss arising out of such an event.
Limitations of liability: insofar as permitted by law, neither the Promoter nor the promotional parties assume any responsibility or liability for:-
1.1. Any incorrect or inaccurate entry, or for any faulty, incorrect, errors or failed electronic data transmissions;
1.2. Any unauthorised access to, or theft, destruction or alteration of entries at any point in the operation of this competition;
1.3. Communications line failure, regardless of cause, with regard to any equipment, systems, networks, lines, satellites, servers, computers or providers utilised in any aspect of this competition;
1.4. Inaccessibility or unavailability of the internet or the social media channels or any combination thereof; Insofar as permitted by law, any injury or damage to participants or to any other person’s computer which may be related to or resulting from any attempt to participate in the competition;
If any of these clauses should be determined to be illegal, invalid or otherwise unenforceable then it shall be severed and deleted from these Terms and Conditions and the remaining clauses shall survive and remain in full force and effect.
Participating countries where legal only. Entrant’s responsibility to verify if the laws of their country allow.
These Terms and Conditions (and any non-contractual disputes/claims which arise out of or in connection with them) will be submitted to the exclusive jurisdiction of the English and Welsh courts.
Data Protection: The Promoter will only use the personal details supplied for the administration of the competition and the auditing of the entries where necessary and for no other purpose. #Together2020 Competition Privacy Notice
This Privacy Notice applies to the processing of your personal data in connection with the #Together2020 competition (“Competition”). The data controller for the Competition is Huawei Technologies UK, 300 South Oak Way, Green Park, Reading, Berkshire, UK, RG2 6UF (hereinafter referred to as "we" or "Huawei"). We understand the importance of your privacy. Please take the time to read this Privacy Notice carefully to understand how we process your personal data.
This Privacy Notice describes:
1. What personal data we collect
For you to be able to participate in the Competition it is necessary for Huawei to collect the following personal data:
- Twitter and Instagram post containing the promotional hashtags, your handle (account name). If you are a winner, we will contact you to obtain additional information in order to fulfil your prize.
We collect this personal data via social media platforms Instagram and Twitter.
2. How we use your personal data
We use only the minimum amount of personal data that is necessary to operate the Competition to:
• processing required for competition, such as select the competition winner
• arrange logistics for delivery of the prize/trip, if you are the winner
We use your personal data for the organisation and logistics of the Competition, and in our legitimate interests for internal reporting purposes to keep track of our activities and for reference in regard to future projects.
If you are the winner, we may need to collate additional personal data to organise the logistics (including the verification and fulfillment) of your prize, including identification details. If we do require to collect any of these types of additional personal data, we will request your explicit consent to do so first.
3. How we use and share your personal data
(1) Sharing with service providers: We use Grayling Communications Limited to help run the Competition. They will only have access to your personal data as required to fulfill their contractual obligations to us in providing services in connection with the Competition. Our service providers are carefully selected and commissioned by us, are bound by our instructions, and will not process your personal data for any other purposes.
(2) We share fulfilment information in order to dispatch and provide a winners prize and entry information into the competition obtained through social media channels.
(3) Legal or regulatory disclosures: Huawei may share your data where there is a reasonable requirement to do so, for example, to meet requirements of applicable law and regulation, or in response to requests from regulators, courts or government agencies; or to establish or defend our legal rights.
Huawei complies with all applicable legal requirements to safeguard EU personal data transferred outside of the EEA. To share data within our corporate group we have entered into EU standard contractual clauses to ensure that an equivalent level of data protection applies to your personal data even where EU data protection law does not directly apply.
4. How long we store your personal data
We retain your personal data for up to a maximum of one year for internal reporting purposes to keep track of our activities and for reference in regard to future projects.
5. How we safeguard your personal data
We implement appropriate technical and organisational security measures to safeguard personal data from unauthorised access, disclosure, use, modification, or loss, including by employing cryptographic technologies to ensure the confidentiality of data in transmission and deploying access control mechanisms to ensure that only limited and authorised personnel can access your personal data where there is a business need to do so.
