HUAWEI GoPaint Worldwide Creating Activity Terms and Regulations
GoPaint is a Huawei-tablet-based painting activity organized and operated by Huawei Device Co., Ltd. (hereinafter referred to as "Huawei", "we", "us", "our", or "organizer").
*For terms relating to HUAWEI GoPaint Malaysia activity, please refer to Appendix 1.
1. You have the right to decide whether to participate in this activity. By taking part in any or all aspects of this activity, you shall be deemed to have fully understood and accepted all the terms and regulations associated with this activity, including the rules and explanations provided in this section.
2. If you are under the age of 18, you are not eligible to participate in the activity.
3. Only works that adhere to the terms and regulations of this activity will be accepted during the participation process.
4. The deadline for submitting works is February 29, 2024, at 24:00 Beijing Time (GMT+8).
5. How to participate in the activity: You can submit your work via My HUAWEI or a third-party social media platform such as Instagram or Facebook. You will be required to log in to your HUAWEI ID for sign-up and select the checkbox for the activity regulations and privacy statement when submitting your work via My HUAWEI. We will collect your HUAWEI ID, nickname, profile picture, and work itself. We will provide you with services based on the service country or region of your HUAWEI ID.
For participants who have submitted the artwork through social media (Facebook or Instagram), please make sure the social account is public and the submitted artwork can viewed publicly with the correct hashtag being used #HUAWEIGoPaint, #HUAWEIGoPaintMY and mention the correct local official HUAWEIMobile Facebook or Instagram account via @huaweimobilemy.
6. Assessment rules: All works submitted by participants will be reviewed by the staff. Works that successfully pass the initial assessment will be further verified to ensure that they have been created using Huawei tablets. Only works that have been verified to have been created using Huawei tablets will be considered eligible for awards. Upon reaching the deadline, the organizing committee will select approximately 100 works as the shortlisted entries for the final assessment phase globally. The selection will be based on criteria such as composition aesthetics, perspective creativity, subject matter and meaning, relevance to the theme, and extension feasibility of the works. Subsequently, the organizing committee will evaluate and score the shortlisted works using the same criteria for the final assessment.

2,000 USD (including taxes) provided by HUAWEI GoPaint Creation Fund

* The organizer reserves the right to adjust the number of prize winners, based on real world conditions.
8. All works submitted for this activity must be paintings created using Huawei tablets. There are no restrictions on the painting creation time or the specific models of Huawei tablets used. You warrant that you hold independent, complete, clear, and undisputed copyright to the work you submit for this activity and that your work does not infringe upon the personal or property rights of any third party, including but not limited to intellectual property rights, portrait rights, reputation rights, privacy rights, and property rights. Each user who participates in the activity acknowledges and understands that they have the right to decide whether to participate in the activity. By participating in this activity, you are deemed to have agreed to these rules. The participants shall bear all legal liabilities arising from any disputes caused by their violation of the aforementioned rules. The organizer shall not assume any responsibility therefrom.
9. The works submitted must be in either JPG or PNG format. The image resolution should be equal to or greater than 300 dpi. The size of each individual image must not exceed 20 MB. Additionally, when uploading a work, you are required to provide a text description for each work, consisting of 30 to 80 words.
10. The works must comply with the specifications and be of authorship. Works that have been created using AI-generated content (AIGC) will not be accepted. Additionally, any works that involve the use of AIGC tools to generate images or elements will be deemed ineligible for the final assessment process. Only works that align with the designated activity themes will be eligible for participation. Works that are irrelevant to the activity themes will not be considered for the assessment process.
11. Participants are not allowed to use works of others as their own works in whole or in part in any manner. Participants need to ensure the submitted artwork are being produced originally with the HUAWEI MatePad. The participants shall bear all legal liabilities arising from any disputes caused by their violation of the aforementioned rules.
12. Participation in the activity is free of charge, and there will be no return of any submitted entries. Only electronic submissions will be accepted. Ensure that your work has been successfully published when participating in the activity. Any work that has been deleted or has not been published successfully cannot be traced during the statistics collection process. Participants shall assume full responsibility for any losses and consequences that may arise as a result.
13. As a participant of this activity, you undertake to abide by the laws and regulations of the People's Republic of China and the country/region where you are located, and shall not release or upload any information that is subversive, pornographic, violent, terrorist, or otherwise illegal. Any works that are found to be in violation of applicable laws and regulations, or are deemed by the organizer to have undermined social order or public morality, will be disqualified from the activity.
14. Works that do not comply with the rules of the activity will not be eligible for the awarding process. If a work that does not comply with the rules of the activity was ever shortlisted or awarded, the organizer reserves the right to revoke the eligibility of any award associated with that work. The organizer reserves the right to revoke or cancel any bonuses, prizes, medals, certificates, as well as any other benefits and interests granted to such a work, and to publish relevant information regarding this action on its official website and other media channels.
15. Participants agree to authorize the organizer and its affiliates to use their submitted works for advertising, as well as product and brand marketing, free of charge from the date of submission, including global use through online media, print media, printed materials, exhibitions, retail stores, roadshows, digital content, out of home media, and other marketing activities. In view of the foregoing, the organizer shall not notify the participants or obtain their consent when using the works submitted by participants for the activity. The organizer has the right to re-delegate the aforementioned rights to strategic partners without obtaining the participants' consent.
16. Any and all materials on the official website of GoPaint Worldwide Creating Activity are protected by copyright laws of all countries and regions around the world. Unless a written consent from Huawei is obtained, it is prohibited to use any of such materials for any commercial purpose in any manner (including copy, modification, uploading, posting, transmission, distribution, licensing, selling, and publication). Huawei's prior written consent is required for the use of any of such materials for any purpose other than personal use.
17. Huawei will do its utmost to provide accurate and up-to-date information on the official website of GoPaint, but Huawei neither provides any guarantee or representation on the accuracy, correctness, reliability, or any other aspects of such information, nor assumes any liability for any omission or error (including but not limited to printing errors and technical errors) in said information.
18. You are responsible for any and all risks incurred when using and browsing the website. Huawei, any other party that participates in the creation, production, or delivery of said website, as well as the title sponsors, activity sponsors, and any third party and partner affiliated to Huawei are not liable for any direct, consequential, incidental, indirect, or punitive damages caused by your access, use, browsing, or download of any materials, data, text, photos, paintings, or audio on said website, including but not limited to computer device damage, virus infection, or other property loss. In addition to the aforementioned content, all other content available on the website is provided on an "AS-IS" basis, and no express or implied warranty of any kind is provided, including but not limited to any warranties regarding merchantability, fitness for a particular purpose, or non-infringement.
19. If your work is shortlisted for an award, the organizer will contact you. In this instance, kindly submit the original copy of your work along with your personal information, copyright notice, authorization statement for your work, and any other required documents. Please ensure that you sign your name and send a copy of the aforementioned documents to the organizer via email. Failure to submit the required documents within the specified period or submission of documents that do not meet the organizer's requirements will result in you being considered to have voluntarily waived your shortlisting qualification. In such cases, your position will be taken by the participant who ranks next in line. The participant is required to respond to the private message from HUAWEI within 3 days otherwise will be deemed as abstention.
20. You agree and acknowledge that the personal information provided, including your name, phone number, country/region, passport, ID card, and bank account information, is accurate and true. This information will be used for contact purposes and for prize distribution. The organizer collects and processes your personal information only for the aforementioned purposes and to the extent permitted by applicable laws. For more information, please refer to the Statement About HUAWEI GoPaint Worldwide Creating Activity and Privacy. Please ensure that the personal information provided by you is complete and accurate. After announcing the winners, the organizer will contact the winners to verify their registration information. In the event that the prize cannot be distributed due to incomplete personal information provided by you, it will be considered as a voluntary waiver of your entitlement to the prize. The organizer shall not be obligated to re-issue the prize to you.
21. If the prize cannot be distributed due to the winner's own reasons (including but not limited to failing to fill in the contact information within three days after the activity ends, or inaccurate or incomplete contact information that makes it impossible for the organizer to contact the winner), it will be deemed that the winner has voluntarily waived their right to receive the prize. The organizer shall not bear any responsibility for this matter and shall not be obligated to re-issue the prize. Upon receiving the prizes, winners are required to verify the completeness of the items. If any exceptions or discrepancies are found, the winner should notify the issuer directly.
22. The prizes of 5,000 USD for Best Award works and 2,000 USD for Honorable Mention winners can only be disbursed via bank wire transfer. The winner shall be responsible for any additional bank charges in accordance with the applicable regulations of their country or region of residence.
23. The winner shall bear the responsibility for any individual income tax incurred as a result of this activity. Huawei will determine whether to withhold and pay the tax in accordance with relevant tax requirements.
24. Any dispute arising out of or in connection with this activity shall be subject to good faith negotiation. If no agreement is reached within fifteen (15) days from the initiation of the aforementioned negotiations, both parties agree to submit the dispute to the People's Court of Longgang District, Shenzhen, Guangdong Province, China for legal proceedings.

Appendix 1: HUAWEI GoPaint Malaysia Activity
In conjunction with the HUAWEI GoPaint Worldwide Creating Activity, this HUAWEI GoPaint Malaysia Activity (the “Contest”) is provided by Huawei Technologies (Malaysia) Sdn. Bhd. (hereinafter referred to as "Huawei", "We", or "Organizer").
The terms of the HUAWEI GoPaint Worldwide Creating Activity shall be applicable subject to necessary modifications, in particular as set out in the terms contained in this Appendix 1 herein.
The assessment process of the works collected for the Contest is conducted by Huawei Technologies (Malaysia) Sdn. Bhd. You may participate in the activity and publish your work in My HUAWEI after selecting the checkbox for the activity regulations and privacy statement. By doing so, you agree to submit your works to the activity and authorize the organizing committee of Huawei Technologies (Malaysia) Sdn. Bhd.to assess your works in accordance with the Privacy Statement.

All submissions to the HUAWEI GoPaint Malaysia activity shall be subject to the same requirements as the HUAWEI GoPaint Global activity, including but not limited to the requirement for the work to be created using Huawei tablets, that the work is independently created, that the work is in JPG/PNG format and must not exceed 20MB, and the text description consisting of 30 to 80 words. | 11. | This Contest does not charge any fees or return any submissions, and accepts electronic submissions only. Any losses and consequences arising from not submitting entries or passing the review shall be assumed by you. | ||
| 12. | All participants agree to abide by the relevant laws of Malaysia, and shall not use this platform to publish any illegal content, including seditious, pornographic, violent, or terrorist images and/or data. Submissions that violate applicable laws and regulations or that the Organizer regards as disruptive to social order or public ethics shall be disqualified from the Contest. | ||
| 13. | The Organizer reserves the right to pre-screen all submissions. Submissions that do not comply with the Contest rules contained herein shall not be selected for this Contest. Should such submissions be selected, they are not exempt from later disqualification, and the Organizer is entitled to reclaim any prizes, awards, medals, written certificates, and other awarded rights and interests, and publicize such action on its official website and other media. | ||

In this instance, kindly submit the original copy of your work along with your personal information, copyright notice, authorization statement for your work, and any other required documents. Please ensure that you sign your name and send a copy of the aforementioned documents to the organizer via email. Failure to submit the required documents within the specified period or submission of documents that do not meet the organizer's requirements will result in you being considered to have voluntarily waived your shortlisting qualification. In such cases, your position will be taken by the participant who ranks next in line. | 20. | You agree and acknowledge that you shall provide authentic personal information, including your name, contact number, email address, and correspondence address, for the purposes of contact and award distribution. The Organizer shall collect and process your personal information solely for the aforementioned purposes and to the extent permitted by applicable laws. For more information about how the Organizer processes and protects your personal data, please refer to the privacy statement. You shall guarantee that the personal information provided by you is complete and accurate. The Organizer shall contact you to verify your registration information after the announcement of the award. If an award cannot be distributed to you due to incomplete personal information, it shall be deemed that you have waived the right to claim the award, and no award shall be distributed to you. | ||

| 22. | Prizes are not redeemable for cash. In the event that the award cannot be presented due to unforeseen circumstances, the Organizer has the right to distribute an award of equivalent value as an alternative, but replacement awards are also not redeemable for cash. Any physical prize (such as a phone) will only be delivered to you by express delivery, and the electronic certificate will be delivered to you by email. | ||
| 24. | You shall assume personal income taxes incurred as a result of this Contest. Huawei shall decide whether to withhold and remit the tax on behalf of the winners based on relevant tax requirements. The Organizer shall bear domestic and international freight costs incurred for shipping the awards. | ||
| 25. | HUAWEI reserves the right to adjust these rules with reason and in accordance with standard practices of similar competitions and open calls. In the event that the adjustments consist of material changes and will have a significant impact on your rights and obligations, Huawei will inform you using appropriate means. Please review these terms regularly to ensure you are aware of any changes made by HUAWEI. Your continued use of the Site after changes are posted means you agree to be legally bound by the updated and/or amended terms. | ||
| 26. | Any disputes arising from or in connection with this Contest shall be negotiated in good faith. If no agreement has been reached within fifteen (15) days from the date on which the aforementioned negotiation starts, the parties agree to submit the dispute to the Malaysia Court. | ||
