HUAWEI Postal Repair – Terms and Conditions

HUAWEI Postal Repair is provided by HUAWEI Technologies (UK) Co., Ltd. (“HUAWEI”) to consumers in the UK in respect of devices which receive HUAWEI’s limited warranty as provided on our website: https://consumer.huawei.com/uk/support/warranty-policy/ (“Warranty”).

Nothing in these terms and conditions shall affect your rights under the Warranty or your statutory rights as a consumer against the original retail seller of the device.

IMPORTANT: If the device or damage is found not to be covered by the Warranty, charges may apply for any repair (see section 4 below). If you are not sure whether your device falls within the Warranty, please contact our Customer Services.

IMPORTANT: It is your responsibility to ensure that your device is properly packed prior to dispatch. Please follow the guidelines from HUAWEI on packaging your device correctly. HUAWEI shall not be liable for any loss or damage that is caused during transit due to poorly packaged products.

DATA PROTECTION: HUAWEI shall process your personal data in accordance with HUAWEI Support Service Privacy Notice. Please read the Privacy Notice prior to proceeding with the HUAWEI Postal Repair.


1. BEFORE SENDING YOUR DEVICE


IMPORTANT: A FACTORY DATA RESET WILL BE CARRIED OUT AT OUR AUTHORISED SERVICE CENTER ("ASC") TO ERASE ALL DATA ON YOUR DEVICE.

Please ensure that you backup and save any software, data, files and programs before dispatching your device for a repair. You are advised to remove all personal information on your device.

When your device contains a SIM card, storage media (e.g. memory card) or other accessories (together, the "Accessories"), you should keep hold of such Accessories and HUAWEI cannot be held liable for any damage or loss to such Accessories that you have failed to keep hold of.

HUAWEI is not responsible or liable for the damage to or loss of any programs, data, SIM card or removable storage media where you do not backup your data.


2. DISPATCH


We recommend that you send the device to us within two (2) calendar days of submission of your postal repair request. If our ASC does not receive your device within fourteen (14) calendar days of your request, your postal repair request will be automatically cancelled. In this case, you would need to submit a new repair request.

Although we shall do our best to adhere to time frames for the repair and completion of the HUAWEI Postal Repair, please note that HUAWEI shall not be liable where we are unable (using reasonable effort) to provide the HUAWEI Postal Repair as a result of any event outside our reasonable control.


3. LIMITATION


HUAWEI will not be liable for any loss or damage caused wholly or mainly by your breach of these terms and conditions.

It is your responsibility to ensure that you enter correct information when requesting HUAWEI Postal Repair and that you package and dispatch your device in accordance with HUAWEI’s instructions.

As a consumer your use of the device shall be non-commercial. HUAWEI shall therefore not be liable to you for any loss of profits, revenue, anticipated savings contracts or time arising out of your use of or inability to use the device.

In the event that your device is not covered by the Warranty (see section 4), HUAWEI’s liability for your device in the event of any loss or damage during transit shall be limited to the amount actually paid by the consumer for the device or the current replacement value, whichever is lower. If either party cannot do what we have promised because of something beyond our reasonable control such as lightning, flood, exceptionally severe weather, fire, explosion, war, civil disorder, industrial disputes, acts or omissions of persons for whom we are not responsible, or acts of local or central government or other competent authorities, such party will not be liable for this.

Nothing in these terms and conditions shall exclude or limit HUAWEI’s liability for death or personal injury resulting from our acts or omissions or those of our servants, agents or employees.

4. OUT OF WARRANTY


Upon inspection if we believe your device or the particular fault is not covered by the Warranty, our Authorised Service Centre (“ASC”) will contact you by post, phone or email (if available) advising you that: a) your device or the particular fault will not be covered by the Warranty; and, b) that if you wish your device or the particular fault to be repaired directly by the ASC as an out of warranty repair, the quote for such repair as set by the ASC. If you do not accept our ASC’s quote for the out of warranty repair within 7 calendar days of being sent to you or, if the device is considered beyond economical repair (i.e. liquid contamination etc.), your device will be returned to you unrepaired.


5. MISCELLANEOUS


HUAWEI Postal Repair is subject to availability and may be withdrawn at any time. HUAWEI makes no warranty that the HUAWEI Postal Repair will meet your exact requirements or that it will always be available.

If any provision of these terms and conditions is held invalid by any law, rule, order or regulation of any government, or by the final determination of any court of a competent jurisdiction, such invalidity shall not affect the enforceability of any other provisions not held to be invalid.

You may not but we may assign, change or otherwise dispose of rights under these terms and conditions. Any attempt by you to do so shall be void.

These terms and conditions shall be governed and construed in accordance with English Law and subject to the exclusive jurisdiction of the English Courts.

By proceeding with HUAWEI Postal Repair request, you are deemed to have agreed to be bound by the term and conditions outlined above. This does not affect your statutory rights.
