HUAWEI Care Terms and Conditions - Extended Warranty Service

By purchasing the Extended Warranty Service (“Service”), you confirm that you have read and agree to these Terms and Conditions which constitute the contract between you and Huawei Technologies (UK) Co., Ltd. of Earley East, Thames Valley Park Drive, Reading, RG6 1PT, United Kingdom (“HUAWEI”, “we” or “us”) in relation to the Service. You can save these Terms and Conditions or print them for future reference. HUAWEI will also save the text of the entire contract and make it available to you upon request.


1. Important Information on Consumer Law


The Service is separate and in addition to the legal rights of consumers under the HUAWEI Limited Warranty and under laws governing the sale of consumer goods, and, therefore, does not affect, change or replace such rights.


In particular, consumers in the UK have rights under the Consumer Rights Act 2015 that protect them from defective goods. For goods purchased in England or Wales, these rights expire six years from delivery of the goods, and for goods purchased in Scotland, these rights expire five years from delivery of the goods. You can obtain further advice on these rights from the Citizens Advice Bureau.


2. Availability

The Service is optional, chargeable and only offered by HUAWEI with respect to certain HUAWEI branded products purchased from the official HUAWEI online store in the UK (“Products”).


The Service does not have to be purchased at the same time as the Product. You can buy the Service at any time prior to the expiry of the HUAWEI Limited Warranty.


3. Service Description

The Service provides an extension to the standard HUAWEI Limited Warranty normally applicable to the Products and is subject to the same warranty notice. Extended warranties may be available from other providers. You may also be covered under your household contents insurance or other policies that you may hold.


The Service is not an insurance policy (see Clause 4 below).


The Service shall commence upon expiry of the HUAWEI Limited Warranty period and terminates upon completion of the specified number of years of Service purchased (“Service Period”). Once the Service Period expires, it cannot be renewed.


During the Service Period, the Product will continue to be protected from defects in materials and workmanship under normal use and use in accordance with the respective Product user manual.


The consumer shall not be charged (whether for parts, labour or otherwise) for the repair or replacement of a defective Product carried out during the Service Period by HUAWEI or an Authorized Service Centre.


4. What is not covered by the Service

The Service does not apply to accessories included with the product or purchased separately, including power adapters, removable (not built-in) rechargeable batteries, headphones and data cables.


This Service will not be available for Products where the serial number or warranty seal on the Product is illegible, has been defaced or removed.


The Service applies to the Product as originally supplied. The Service does not apply to any software or other equipment owned by HUAWEI or third parties however, you should check the end-user license agreement, separate warranty/ guarantee statement(s) and/or any exclusions which are provided or intended to apply to such items.


This Service does not cover defects and damage resulting from:


a) Normal wear and tear of the equipment or otherwise due to the normal aging of the equipment.


b) The Product being used other than in a normal and customary manner.


c) Any disassembly, repair, alteration or modifications carried out by anyone other than HUAWEI or an Authorised Service Centre.


d) Misuse, abuse, negligence or an accident howsoever caused.


e) Improper testing, operation, maintenance, installation, or any alteration or modification of the Product.


f) Spillage of food or liquids, corrosion, rust or the use of wrong voltage.


g) Scratches or damage to plastic surfaces and all other externally exposed parts due to normal use.


h) Use outside of use permitted under the Product’s user manual.


Where the Product is assessed to be within one of the categories listed above, HUAWEI or its Authorised Repair Centre will issue a quotation for the repair and a notification will be sent to you via email.

5. How to claim the Service and request a repair

To request a repair under this Service, the consumer must do so by contacting HUAWEI within the Service Period. The repair service is carried out by HUAWEI’s authorized service centre. You must provide proof of purchase indicating the date you purchased the Product. In the absence of proof of purchase or in the event that the proof of purchase is incomplete, HUAWEI may check the serial number of your Product in order to determine a deemed date of purchase of the Product and assess if the Product is covered by the Service.


HUAWEI or its Authorised Service Centre will repair or replace, at HUAWEI's option, the Product or any relevant parts in the event of any defect in the materials and workmanship covered by the Service. Repair or replacement of a Product or part may involve the use of a functionally equivalent reconditioned unit. If the Product is replaced, the Service will be transferred to the new Product.


If your Product is replaced by us in accordance with your legal rights or rights under the Limited Warranty or Service, the Service will be transferred to the new Product.


6. Cancellation

Cancelling the Service: If you wish to cancel the Service (without returning the Product,) you can do so within a maximum period of 45 days from the date of purchasing the Service provided you have not received a repair or replacement of the Product during the Service Period. After this 45 day period, it will not be possible to cancel the Service and no refund will be made.

Return of the Product: If after purchasing the Service, the Product covered by the Service is returned for a full refund within 30 days of delivery, HUAWEI will refund the amount paid for the Service.


7. Limitation

HUAWEI will not be liable for any loss or damage caused wholly or mainly by your breach of these Terms and Conditions.


HUAWEI is not responsible or liable for the damage to or loss of any programs, data, SIM card or removable storage media and you are advised to backup your data before delivering your Product to HUAWEI or an Authorised Service Centre for repair or replacement under the Service.


To the extent permitted by local laws, HUAWEI shall not be liable for any loss which is not a reasonably foreseeable consequence of a breach by HUAWEI of these Terms and Conditions. As a consumer your use of the Product shall be non-commercial. HUAWEI shall therefore not be liable to you for any loss of profits, revenue, anticipated savings contracts or time arising out of your use of or inability to use the Product.


Nothing in these Terms and Conditions shall exclude or limit HUAWEI’s liability for death or personal injury caused by its negligence, fraud, fraudulent misrepresentation or any other liability that cannot be limited or excluded by law.


HUAWEI is not responsible for delays outside its control. If our fulfilment of the Service is delayed by an event outside our control then we will contact you as soon as possible to let you know and we will take steps to minimize the effect of the delay.


In any event, HUAWEI and its supplier’s liability under this limited warranty shall be limited to the amount actually paid by the consumer for the Product or the current replacement value, whichever is greater.


8. Miscellaneous

If any provision of these terms and conditions is held invalid by any law, rule, order or regulation of any government, or by the final determination of any court of a competent jurisdiction, such invalidity shall not affect the enforceability of any other provisions not held to be invalid.


These conditions shall be governed and construed in accordance with English Law and subject to the exclusive jurisdiction of the English Courts.
