O2O Policy

1. Introduction

1.1 This【O2O】 function ("Function") is operated by Huawei Services (Hong Kong) Co., Limited (“Huawei”) for you to order and purchase Huawei Products (as defined below) from our Partners (as defined in paragraph 1.2 below). Both parties to the purchase are Partner and Customer. Huawei only provide Site to facilitate this transaction.

1.3 This O2O Policy, Terms of Purchase with Partner, Huawei’s Privacy Policy (“Privacy Policy”) and terms of use of Huawei Official Online Store (“online store”) will be construed as the terms and conditions of this Function (collectively as “Terms and Conditions”) on which Huawei offers Customer (as defined in paragraph 4.1 below) access to and use of the Site for the purposes of this Function.

1.4 The Partners, as sellers, are solely responsible for the Huawei Products sold to Customer and Customer shall have no other cause of action or claim against Huawei under this Site or in connection with the order, purchase or transaction through this Site. Please contact the Partners directly if you have any question relating to the Huawei Products ordered or purchased on this Site. Please read the Terms of Purchase with Partner below for more information.

1.5 Customer agrees to comply with all the Terms and Conditions when accessing or using this Site.

1.6 Huawei Products available for order to be provided from the Partners on the Site are as follows (“Huawei Product(s)”):

1.7 This Function is open to all registered users of Online Store who are residents in Philippines with an age of eighteen (18) years above.

2. Processing

To order a Huawei Product from Partner on the Site, you will have to complete the steps as follows:

Step 1: Visit Product Page at the Site, Choose your favored Huawei Products

Step 2: Choose the Partner’s offline store and pickup time

Step 3: Fill out your pickup information

Step 4: Agree to terms and conditions for campaigns, Terms of Purchase, Privacy Policy, Terms of use of Online Store and O2O Policy

Step 5: Get pickup code and order information

Step 6: Collect products from the Partner’s offline store and pay the full amounts of purchase price to the Partner.

3. Payment

Customer acknowledges, understands and agrees that all orders, purchases and transactions on this Site are between Customer and Partner. Huawei would not be involved in any payment and refund between Customer and Partner. Any payment for the order or purchase of Huawei Product from the Site will be paid by the Customer to the Partner at the offline store directly. Any refund made to the Customer for Huawei Product on the Site will be performed by the Partner to the Customer directly. If Customer requires any clarification, assistance or refund regarding payment made or Huawei Products ordered from the Site, you shall contact the Partner directly at the contact details displayed at the Partners’ page.

4. Collection

4.1 Upon a Customer chooses the Partner’s offline store, Huawei Products and pick up time at the Site, the Customer shall make the full payment of the Huawei Product(s), pick up the Huawei Product(s) from the chosen Partner’s offline store at the appointed time. The order or purchase of Huawei Product(s) from the Site will constitute an invalid order or purchase and be cancelled if the Customer fails to make the full payment, pick up the Product at the closing time (Philippines Time)) of the selected date at the store as chosen at the Online Store.

5. Customer's Covenants

Customer will not use this Site:

a) to submit fraudulent order, illegal, sensitive, false, inaccurate, misleading, defamatory, or libelous information;

b) to transfer Customer's purchase to another party;

c) to distribute viruses or any other technologies that may harm the website, or the interests or property of other users;

d) to export the Huawei Product purchased except in compliance with the export control laws of relevant jurisdictions and in accordance with posted rules and restrictions;

e) to do anything which may be in violation of the applicable laws, regulations and decrees;

f) in the event Huawei suspects or discovers that the Customer is abusing this Function and/or Customer breaches any of the covenants above, Huawei may, at our sole discretion, take necessary steps to prevent and mitigate such abuse such as limiting, suspending, or terminating the Customer's user account(s) and access to this Site, delaying or removing hosted content, removing any special status associated with Customer account(s), reducing or eliminating any discounts, and taking technical and/or legal steps to prevent Customer from using this Site.

6. Limitation of Liability

6.1 To the extent permitted by applicable law, Huawei excludes all express or implied warranties, terms and conditions including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

6.2 Customer shall assume full responsibility in case of any accident, damage or claim resulting from participating in this Function. All personal costs and/or any other costs, fees and/or related expenses arising out of the collection and purchase of the ordered Huawei Products are the Customer's sole responsibility.

6.3 Customer shall be deemed to have performed a legally binding contract upon you’re your submission of order and there shall not be any refund or costs whatsoever arising from your violation of the minimum age stated herein.

6.4 Huawei shall not be liable or responsible for any breach of conditions, representations or warranties by the Partner, seller(s), manufacturer(s), distributor(s) or any entity or person involved in any transaction relating to the Huawei Product on this Site and hereby expressly disclaim all responsibilities/ liabilities to this effect.

6.5 Huawei shall not mediate or resolve any dispute or disagreement between/amongst Customer and Partner, seller(s) or manufacturer(s), distributor(s) or any entity or person involved in any transaction relating to the Huawei Product on this Site.

6.6 All dispute, differences, claims and else between Partner and Customers in connection with or arising out of the use of Function, the purchase of Huawei Products at the Site shall be settled by the Partner and Customers.

7. Privacy

7.1 By providing Customer's personal data, Customer confirms that you have read, understood and agreed that your personal data will be recorded, stored or otherwise processed in accordance to the Huawei’s Privacy Policy stated (“Privacy Policy”) .

7.2 Customer hereby agrees and provides consent to Huawei and the Partner to process, transfer, disclose and use your personal data for the purposes of completing your order, purchase and transaction on this Site in accordance with the Personal Data Protection laws and regulations, to the extent that any personal data provided shall only be processed, transferred, disclosed and be used by Huawei and Partner for lawful purpose as stated in the Huawei’s Privacy Policy.

7.3 Customer further agrees and provides consent to Huawei and/or the Partner and/or any agents and/or any third party service providers to contact you by telephone, email or such other method in connection with the order, purchase and transaction on this Site.

8. General

Huawei is only a provider of the Site and is not a party to or controls in any manner, any transaction(s) on the Site. Accordingly, the contract of sale of Huawei Products through the Site shall be strictly between Customer and the Partner on the Site.

8.1 The Site and contents thereof are provided for your convenience only. Although Huawei has attempted to provide accurate information on the Site, it assumes no obligation or responsibility regarding the accuracy of the information whatsoever. Huawei may change the contents available on the Site or the Huawei Products mentioned at any time without notice.

8.2 All emails and documents sent by Huawei to Customer for this Function shall be deemed to be sent by/on behalf of the Partner.

8.3 In the event that Customer has provided false or mistaken identity or information to Customer in this Function, Huawei shall have the right to revoke the Customer’s eligibility for this Function.

8.4 By participating in the Function, Customers agree to be bound by this Terms and Conditions and Huawei’s decisions are final and binding. No correspondence or appeals will be entertained. Huawei reserves the right to the final and ultimate interpretation of this Function.

8.5 Huawei shall not be responsible for any losses or damages directly or indirectly incurred by any party including the Customer in connection or arising from acts or omissions or in any way related to this Function.

8.6 The Customer agrees to discharge and release Huawei from any liabilities and claims (including from breach of contract, tort, negligence or any other cause of actions at law or equity) arising out of or in any way connected to this Function or to the Customer’s participation in the Function.

8.7 The Customer further agrees to discharge and release any third party which is related to and connected with this Function from any liabilities and claims (including from breach of contract, tort, negligence or any other cause of actions at law or equity) arising out of or in any way connected to this Function or to the Customer’s entry in the Function.

8.8 By entering into this Function, the Customer agrees to indemnify and hold Huawei and the Huawei Group of Companies, their officers, directors, shareholders, predecessors, successors in title, employees, agents and representatives harmless from any claims, losses, damages, liability, claims or expenses (including any legal fees), suffered or incurred by Huawei due to or in any way arising from this Function.

8.9 If Customers are discovered to be using or have used improper means to participate in this Function, Huawei reserves the right to cancel the eligibility without notice including without hesitation, the commencement of legal proceedings under the full extent of the applicable laws.

8.10 This Function and the Terms and Conditions herein shall be governed by the laws of Thailand.

8.11 Products colour may vary from the illustrated photo(s), depending on the computer/ devices screen resolutions.

8.12 No cash alternative to any free gift in this Function will be offered. The free gifts are not transferable and/or exchangeable, including colour options. Free gifts are subject to availability and we reserve the right to substitute any free gift with another of equivalent value by giving a notice to you. All free gifts in this Function are not covered by warranty. All free gifts in this Function are available on a first-come-first-served basis while stocks last.
