Terms & Conditions for HUAWEI “Claim for Your Extra Care” Campaign

The HUAWEI “Claim for Your Extra Care” Campaign (the “Campaign”) is organised by Huawei Technologies (UK) Co., Ltd. with its registered offices at 300 South Oak Way, Green Park, Reading, Berkshire, RG2 6AD ("HUAWEI" or “we”).

The Campaign will commence on 21st October 2021 and will end on 31st January 2021.

To be eligible to participate in the Campaign you must:

- be aged 18 or over and residing in the UK; and

- have the MyHUAWEI App installed on your Huawei device (version 11.1.6.358 or above). To check your version, open the MyHUAWEI App, select the “Me” tab, scroll to the bottom and open the “About” section, your version number will be displayed near the top of the screen.

The Campaign provides the following benefits: an additional 6 Months Extended Warranty for qualifying handsets (“Extended Warranty Offer”) in accordance with the terms and conditions set forth below.

The Extended Warranty Offer cannot be combined with other offers or promotions.

1.1 Extended Warranty Scope

HUAWEI provides a Limited Warranty in respect of HUAWEI handsets in accordance with its terms and conditions available at: https://consumer.huawei.com/uk/support/warranty-policy/ (the “Limited Warranty”).

This Extended Warranty Offer extends the scope of the Limited Warranty and is only applicable, if and to the extent that the Limited Warranty applies to the relevant product. You will find out if and which Limited Warranty applies to your device at: https://consumer.huawei.com/uk/support/warranty-policy/. The Limited Warranty as well as any statutory rights and remedies shall remain unaffected by the Extended Warranty Offer.

1.2 Qualifying Handsets

This Extended Warranty Offer is limited to the following qualifying handsets:

- Huawei handsets purchased in the UK.

- Huawei handset covered by a warranty (Limited Warranty or purchased Extended Warranty) at the time of registration for the Extended Warranty Offer.

1.3 Registration

You must register for the Extended Warranty Offer through the Huawei Support App between October 21st, 2021 and January 31th, 2021. If successful, the initial warranty period of the handset will be extended for an additional 6 months and this will be indicated in the Huawei Support App within one (1) business day.
You can query the warranty status of your device through the Huawei Support App, on 0800 088 6700, or on the official Huawei website: https://consumer.huawei.com/uk/support/warranty-policy/.

1.4 Limitations

The Extended Warranty Offer does not cover in-box accessories, such as chargers or earphones.

The terms and conditions of the Limited Warranty apply accordingly unless otherwise provided in the terms and conditions of this Extended Warranty Offer. This includes in particular the coverage of the Limited Warranty as well as exclusions, procedure of the Limited Warranty, your responsibility and the limitation of HUAWEI’s liability.

2. Important Notes

2.1 All materials of the Huawei website are protected by the copyright laws of each country throughout the world. Except for cases permitted in writing, it is prohibited to use any material (including duplication, modification, uploading, presentation, transmission, distribution, licensing, sales, and publication) by the copyright laws except for non-commercial and personal purposes. If you want to use any materials on HUAWEI’s official website, you need to obtain prior consent from us.

2.2 While HUAWEI will use reasonable efforts to include accurate and up to date information on the HUAWEI websites, HUAWEI makes no warranties or representations as to the accuracy, correctness, reliability or otherwise with respect to such information, and assumes no liability or responsibility for any omissions or errors (including, without limitation, typographical errors and technical errors) in the content.

2.3 Any information provided by any Huawei Service Centres shall not amount to any warranties (either express or implied) or representations (whether provided in writing or expressed orally) and shall not be relied upon as to accuracy, correctness, reliability or otherwise with respect to such information, and furthermore HUAWEI assumes no liability or responsibility for any omissions or errors (including, without limitation, typographical errors and technical errors).

2.4 HUAWEI excludes liability, to the fullest extent permitted by law, for any loss or damage caused to a participant arising out of or in connection with the Campaign. Without prejudice to the preceding restriction, and to the maximum extent permitted by applicable law, in no event will HUAWEI’s liability to you exceed £50.00.

2.5 HUAWEI reserves the right to withdraw or amend the Campaign or these Terms and Conditions and to disqualify claims which it considers do not comply with these Terms and Conditions at any time at its own discretion. HUAWEI’s decisions regarding all promotional matters will be final, and no correspondence will be entered into.

2.6 If any provisions of these Terms and Conditions are judged to be invalid, illegal or unenforceable, this shall not affect or impact the continuation in full force and effect the remainder of the provisions.The Campaign is governed by English Law and is subject to the exclusive jurisdiction of the English courts.

HUAWEI Care - Official Battery Replacement Service

By purchasing the HUAWEI Care - Official Battery Replacement Service (“Service”), you confirm that you have read and agree to these Terms and Conditions which constitute the contract between you and Huawei Technologies (UK) Co., Ltd. of 300 South Oak Way, Green Park, Reading, Berkshire, RG2 6AD (“HUAWEI”, “we” or “us”) in relation to the Service.

Please note the Service is separate and in addition to the legal rights of consumers under the laws governing the sale of consumer goods, and, therefore, does not affect, change or replace such rights.

1. Service Name:

HUAWEI Care - Official Battery Replacement Service.

2. Service Description:

The Service provides a battery replacement for devices in circumstances where such replacement is chargeable and not covered by HUAWEI’s Limited Warranty (see: https://consumer.huawei.com/uk/support/warranty-policy/). The battery replacement is carried out by HUAWEI’s Authorised Service Centres in the UK.

Participating Devices: The Service is only available for participating HUAWEI devices purchased in the UK and is subject to spare parts availability. To see if the Service is available for your device please visit: [INSERT LINK TO CHECK DEVICE ELIGIBILITY].

Validity Period: You must book the Service with a HUAWEI Authorised Service Centre in the UK within 30 days of its purchase by contacting the HUAWEI Customer Service hotline on 0800 088 6700.

3. Service Features:

Original Battery: your battery will be replaced with an official HUAWEI battery.

90 Day Warranty: Your new battery will benefit from 90 days of warranty (see HUAWEI’s Limited Warranty for terms).

Official Service: Our HUAWEI Authorised Service Centre uses certified repair engineers who strictly follow HUAWEI’s official detection & repairs process.

Recycling: Our HUAWEI Authorised Service Centre will process your old battery for recycling free of charge.

4. Refund Policy:

If the Service is not booked within the Validity Period, you can call HUAWEI Customer Service hotline 0800 088 6700 and request a refund. Once processed, the refund will be returned to the original payment account within 7 working days.

If the Service is not booked within the Validity Period and you did not request a refund, HUAWEI will automatically process a refund after the expiry of the 30 day period. Once processed, the refund will be returned to the original payment account within 7 working days.

5. What is not covered by the Service

Please note the Service does not cover:

Other items beyond the replacement of the battery.

Damage to your device caused by misuse, abuse, negligence or an accident howsoever caused.

A device which has been disassembled, repaired, altered or modified somewhere other than a HUAWEI Authorised Service Centre.

A battery other than the version of HUAWEI battery as installed by HUAWEI and supplied on the date of the original retail purchase of the device.

6. Additional Charges:

If upon inspection of your device the HUAWEI Authorised Service Centre determines that non-battery related components are damaged and require repair or replacement in order to replace the battery or to make the device operational, you may be offered the option to make a payment for the additional repairs before the repair and battery replacement is performed.

If the damage is unrepairable or you choose not to have the additional repair carried out, your device will be returned to you unrepaired and you will receive a refund on the purchase of the Service.

If upon inspection of your device the HUAWEI Authorised Service Centre determines that non-battery related components are damaged and require repair or replacement in order to replace the battery or to make the device operational, you may be offered the option to make a payment for the additional repairs before the repair and battery replacement is performed.

If the damage is unrepairable or you choose not to have the additional repair carried out, your device will be returned to you unrepaired and you will receive a refund on the purchase of the Service.

7. Limitation:

1) HUAWEI will not be liable for any loss or damage caused wholly or mainly by your breach of these Terms and Conditions.

2) HUAWEI shall not be liable where we are unable (using reasonable effort) to provide the Service as a result of any event outside our reasonable control.

3) When your device contains a SIM card, memory card or other accessories (together, the “Accessories”), you should keep hold of such Accessories during the provision of the Service and HUAWEI cannot be held liable for any damage or loss to such Accessories that you have failed to keep hold of.

4) It is your responsibility to backup and save any software, data, files and programs before commencement of the battery replacement and to restore the same on your device when it is returned to you.

5) You acknowledge that we may reset the default settings on the device in order to conduct the Service. This might delete data, settings and files on the device.

6) Where relevant, you must make sure that you backup any important data stored on the device prior to commencement of the battery replacement as HUAWEI assumes no responsibility for any claims relating to loss of data, programs or software.

7) Nothing in these Terms and Conditions shall exclude or limit HUAWEI’s liability for death or personal injury resulting from our acts or omissions or those of our servants, agents or employees.

8. Repair Process:

1) In Store Repair: You can take your device to a HUAWEI Authorised Service Centre for replacement, with an approximate repair time of 1 hour. In order to avoid waiting time at the store, we recommend that you make an appointment in advance.

2) Postal Repair: You can send your device by postal repair, it usually takes 5-7 working days.

Please note that the Service is subject to availability of spare parts and capacity at the HUAWEI Authorised Service Centre during designated service hours. Although we shall do our best to adhere to the above time frames for completion of the Service, a longer repair time might apply if the relevant HUAWEI Authorised Service Centre does not have the replacement battery in stock.

9. Termination:

The Service will terminate after you receive a battery replacement or when the Validity Period expires, whichever event occurs earlier.

10. Miscellaneous:

The Service is subject to availability and may be withdrawn at any time, if the Service is not available when you request it you will not be charged. HUAWEI makes no warranty that the Service will meet your exact requirements or that they will always be available.

2) If any provision of these terms and conditions is held invalid by any law, rule, order or regulation of any government, or by the final determination of any court of a competent jurisdiction, such invalidity shall not affect the enforceability of any other provisions not held to be invalid.

3) You may not but we may assign, change or otherwise dispose of rights under this agreement. Any attempt by you to do so shall be void.

4) These terms & conditions shall be governed and construed in accordance with English Law and subject to the exclusive jurisdiction of the English Courts.


GENERAL TERMS AND CONDITIONS FOR HUAWEI VIDEO 1 YEAR DISCOUNTED SUBSCRIPTION (“THE CAMPAIGN”)

1. Terms and Conditions Binding

By entering the Campaign, you agree to accept and to be legally bound by all of these Terms and Conditions.

2. Campaign Organiser

This Campaign is organised by Aspiegel SE (“Aspiegel”), a company incorporated in Ireland with its registered address at: First Floor, Simmonscourt House, Simmonscourt Road, Dublin 4, D04 W9H6, Ireland. Aspiegel is part of the Huawei group of companies.

3. Campaign Territory

4. Duration of Campaign

The Campaign will start at 00:00 ON 21TH OCTOBER 2021 (GMT+1) and will finish at 23:59 ON 31ST JANUARY 2022 (GMT+1).

5. How to Enter

5.1 Entry is free of charge.

5.2 This offer is only available to Huawei device users whose unique HUAWEI ID is registered within the Campaign territory stated in Section 3, where the Participant also resides. The Participant’s HUAWEI ID service region and IP address shall also correspond to their country of residence.

5.3 Participant must have a HUAWEI device.

5.4 Participant must have never subscribed to HUAWEI Video+ service.

5.5 Must upgrade your HUAWEI Video app to the last version from HUAWEI AppGallery.

6. Award of Prizes

6.1 By entering the Campaign, Participants will have a chance to claim a discount voucher. The Voucher entitles you to 30% discount on the HUAWEI VIDEO+ yearly subscription service, valued:

6.2 By tapping the ‘Claim Now’ button on the Campaign page and accepting the Terms and Conditions, Participants will be able to claim one 30% discount Voucher. The Voucher can be used only on HUAWEI Video+ Yearly Subscription.

6.3 The total number of 30% Discount Voucher awarded during the Campaign period in the Campaign territory is 10,000. They will be given away on a first come, first served basis.

6.4 The maximum number of HUAWEI Video+ Voucher that may be awarded to each Participant during the Campaign is 1.

6.5 When they claim a Voucher, Participants in the Campaign will receive a pop-up message informing them that they have successfully claimed the HUAWEI Video+ Voucher.

6.6 The 30% Discount Voucher is valid for 30 days from date of receipt.

6.7 Proof of identity may be requested by Aspiegel as a proof of age before a prize is awarded.

6.8 Prizes are not negotiable nor transferable.

7. Additional Conditions

7.1 You must be 18 years or over.

7.2 You may not take part in the Campaign if you are an employee of Aspiegel or any of its related Huawei company affiliates, or if you are connected in any way to such an employee, whether by familial relationship, friendship, or otherwise.

7.3 Aspiegel reserves the right to hold, void, suspend, cancel, or amend the Campaign if, at its sole discretion, it becomes necessary to do so for any unforeseen reasons or any reasons that are out of its control.

7.4 To the fullest extent permitted by law, Aspiegel (including its affiliate Huawei companies) and its agents or distributors, will not in any circumstances be responsible or liable (a) to compensate a Participant or accept any liability for any loss or damage, personal injury or death, as a result of entering the Campaign or accepting a prize; and/or (b) for any matters connected with or arising from your or a third party’s use of a prize, should you win one. Your statutory rights are not affected.

7.5 By participating in the Campaign, you hereby indemnify and hold harmless Aspiegel (or if relevant, your social media account provider(s)) from any and all liabilities associated with the Campaign. The Campaign is in no way sponsored, endorsed or administered by, or associated with your social media account provider(s).

7.6 Aspiegel processes and uses any personal data provided by entrants for the purposes of this Campaign in accordance with the local applicable laws and the EU General Data Protection Regulation (GDPR). To the extent that you provide any personal data, it shall only be processed for lawful purposes directly related to this Campaign, including but not limited to any administrative matters to facilitate the management and organising of this Campaign, as well as delivering the prize to the winner and fraud prevention. 7.7 Aspiegel reserves the right to draw an alternative winner if it believes that any winner has contravened any of these Terms and Conditions.

7.8 This Campaign and the Terms and Conditions herein shall be governed by and interpreted in accordance with the laws of Ireland. Nothing in these Terms shall exclude, limit, or restrict your rights under local mandatory consumer laws.

7.9 This document may be translated into multiple languages. Should any conflict arise between the English-language version of this Agreement and any translation hereof, the English-language version shall prevail.

7.10 Aspiegel gives no warranties, representations, or guarantees, express or implied, in fact or law, relating to any prize(s), regarding the use, value, or enjoyment of the prize(s), including, without limitation, its quality, mechanical condition, merchantability, or fitness for a particular purpose.

7.11 Any tax payable (including personal income tax) that is applicable as a result of a prize being awarded or received will be the responsibility of the prize winner. If any claim is made against Aspiegel for such taxes, the prize winner shall indemnify and hold Aspiegel harmless for any liability for such sums and promptly remit to Aspiegel such sums together with any penalties and interest assessed.

The User may enjoy the discount on their first subscription period only (i.e. the first period for monthly subscriptions is the first month; the first period for half-yearly subscriptions is the first 6 months; the first period for yearly subscriptions is the first 12 months). Once Users’ subscriptions expire, their subscriptions will auto-renew to the same plan at the original price (undiscounted price).

6.4 Users may cancel their subscription at any time they wish; they shall not receive a refund but can still enjoy the Cloud service until their subscription expires.

6.5 Six (6) month and twelve (12) month non-subscription plans are a one-off payment, meaning that the user pays for several months at a time, and when their account expires, they need to make a manual payment if they wish to continue using the HUAWEI Cloud service.

5. How to Enter

5.1 Participating in the Campaign is free of charge.

5.2 You must possess a Huawei smartphone with EMUI version 4.0 or above.

5.3 This campaign is for all Music users including Premium users and new users.

5.4 Your HUAWEI ID must be associated with a valid debit or credit card.

5.5 You shall follow the below steps to participate in this Campaign:

5.5.1 Register or log into HUAWEI Music with your HUAWEI ID.

5.5.2 Upon entering the Carnival campaign page, you will see a dedicated banner, related to the 1 (One) year Music Premium 30% off promotion; tap on this banner to be redirected to Music H5 page. On entering the H5 page, you will see a “GET NOW” button to participate in the 1 (one) year Music Premium 30% off promotion.

5.5.3 Tap on the “GET NOW” button to participate in the one year Music Premium promotion.

5.5.4 Following subscription, Participants can visit HUAWEI Music > Premium to verify that the one year Music Premium has successfully been activated.

6. Special Conditions for this Campaign

6.1 Each HUAWEI ID owner has only one opportunity to join this Campaign.

6.2 You can cancel the subscription at any time before it expires.

6.3 Once the 1 year subscription ends, the standard fee-charging subscription will be automatically renewed.

6.4 Prices of the monthly subscription charge are as follows:

i. EUR 9.99 per month for Germany, Ireland, Spain, France, Italy, Finland, Belgium, Austria, and the Netherlands;

ii. EUR 6.99 for Greece and Portugal;

iii. GBP 9.99 for the UK;

iv. SEK 99 for Sweden;

v. DKK 99 for Denmark;

vi. NOK 99 for Norway;

vii. CHF 12.90 for Switzerland.

6.5 Upon cancellation, the paid subscription will not be refunded. Users can continue to use HUAWEI Music until such paid period has expired.

7 Additional Conditions

7.6 Aspiegel processes and uses any personal data provided by Participants for the purposes of this Campaign in accordance with the local applicable laws and the EU General Data Protection Regulation (GDPR). To the extent that you provide any personal data, it shall only be processed for lawful purposes directly related to this Campaign, including but not limited to any administrative matters to facilitate the management and organising of this Campaign, as well as delivering the prize to the winner and fraud prevention. Such purposes require us to process HUAWEI ID and payment information. Any personal data provided by Participants in connection with the Campaign is retained for no longer than 12 months after the Campaign. In general, when you use Aspiegel services, such as HUAWEI MUSIC, your personal data shall be processed in accordance with the respective Privacy Statement.

7.7 Aspiegel reserves the right to draw an alternative winner if it believes that any winner has contravened any of these Terms and Conditions.

7.8 This Campaign and the Terms and Conditions herein shall be governed by and interpreted in accordance with the laws of Ireland. Nothing in these Terms shall exclude, limit, or restrict your rights under local mandatory consumer laws.

7.9 This document may be translated into multiple languages. Should any conflict arise between the English-language version of this Agreement and any translation hereof, the English-language version shall prevail.

7.10 Any tax payable (including personal income tax) that is applicable as a result of a prize being awarded or received will be the responsibility of the prize winner. If any claim is made against Aspiegel for such taxes, the prize winner shall indemnify and hold Aspiegel harmless for any liability for such sums and promptly remit to Aspiegel such sums together with any penalties and interest assessed.

7.11 Aspiegel gives no warranties, representations, or guarantees, express or implied, in fact or law, relating to any prize(s), regarding the use, value, or enjoyment of the prize(s), including, without limitation, its quality, mechanical condition, merchantability, or fitness for a particular purpose.
