HUAWEI STORE PHILIPPINES TERMS AND CONDITIONS

1. INTRODUCTION:

The HUAWEI STORE LAUNCH PROMOTION (the "Promotion") is organized by TWIRELESS INC., (the "Organizer") with its registered offices at UNIT 1506-A WEST TOWER, PSE CENTRE, EXCHANGE RD., ORTIGAS CTR. All participants to the Promotion (“Participant(s)”) shall be deemed as having agreed to the following terms and conditions (the “Terms and Conditions”).

Campaign Mechanism:

A: Eligibility

In order to participate in this Campaign, customers (“Customer(s)”) must be:

A Huawei Store registered user on HUAWEI Philippines Online Official Store (https://www. consumer.huawei.com/ph ) (“Huawei website”);

A HUAWEI Store registered user on HUAWEI Philippines App by download HUAWEI STORE Philippines App (“HUAWEI Philippines App”).

A resident in Philippines; and eighteen (18) years of age and above as of 29th October 2020.

B: Campaign Events:

This Campaign consists of the following two (2) events:

1. Pre Order HUAWEI Y7a

a) This “Pre Order HUAWEI Y7a” event will run from (GMT+8) 29th October 2020, 14:00 PM till 6th November 2020, 23:59 PM (“Pre Order HUAWEI Y7a”).

b) Customer who pre order a HUAWEI “Pre Order HUAWEI Y7a” within the Campaign Period will be able to receive the corresponding Free Gifts (where applicable) as set out below:

c) Each Customer with the same registered account of HUAWEI Store can only purchase a maximum of five (5) units of each HUAWEI Pre Order Offer Product throughout the Campaign Period.

d) The deposit paid of HUAWEI Y7a is non-refundable.

e) Bluetooth Headset for HUAWEI Y7a is available for the first five hundreds (500) participants who pay the deposit and the final payment of the Y7a during the campaign periods.

f) The Promotion is only applicable to purchase of the HUAWEI Y7a made on the HUAWEI Store during the Campaign Period.

g) Only one (1) gift can be redeemed per product (i.e. for the entire shopping cart comprising that transaction).

h) Free Gifts are not exchangeable for cash or other items, and are non-transferable.

i) Free Gifts have minimum warranty of Organizer.

j) Free Gifts during HUAWEI Pre Order Offer campaign period have limited amount.

a) Customer who had completed made final payment of HUAWEI Y7a can contact customer service to get the URL link for redeem other benefits.

2. “HUAWEI Early Christmas Promotion” Event

a) This “Huawei Early Christmas Promotion” event will run from 00:00AM (GMT+8), 1st November 2020 to 23:59PM (GMT + 8), 15th November 2020 (“Huawei Early Christmas Promotion”).

b) This offer can be valid on HUAWEI STORE Philippines from 1st November 2020 to 15th November 2020.

c) The free gifts is only applicable to purchase of the HUAWEI Matebook D14.

d) Each Customer with the same registered account of HUAWEI Store can only purchase a maximum of five (5) units of each product throughout the Campaign Period.

e) Free Gifts are not exchangeable for cash or other items, and are non-transferable.

f) Free Gifts have minimum warranty of Organizer.

g) Free Gifts during “Huawei Early Christmas Promotion” campaign period have limited amount.

h) Free Freebuds 3i gift for HUAWEI MATEBOOK D14 R5 is available for the first one hundreds (100) participants who purchase HUAWEI MATEBOOK D14 R5 order during the campaign periods.

i) Free Backpack gift for HUAWEI MATEBOOK D14 R7 is available for the first one hundreds (100) participants who purchase HUAWEI MATEBOOK D14 R7 order during the campaign periods.

3. GENERAL

All products, Coupons and free gifts made available through this Promotion may have limited stocks

The Organizer reserves the right to substitute the Prize and Free Gifts for another Prize or Gift of similar value and characteristics if, due to unforeseen circumstances, said Prize was not available during the promotional period.

The Participant agrees and provides consent to Organizer to the use of any Personal Data as provided by the Participant for the purpose of participation in this Promotion in accordance with the Personal Data Protection laws and regulations, to the extent that any personal data provided shall only be processed and be used by Organizer for lawful purpose directly related to the running of this Promotion including but not limited to the purposes of promotional events, advertising, marketing and any administrative matters to facilitate the management and organizing of this Promotion.

By participating and agreeing to this Terms and Conditions, Participant confirms that he/she has read and understood the Organizers’ Privacy Policy” stated at https://consumer.huawei.com/ph/support/service-privacy-notice/. The Participant agrees that Organizer and/or its agent and/or its third party service providers may contact them by telephone, email or such other method in connection with this Promotion.

In the event any prizes are being awarded to the participant having provided false identity or information, Organizer shall have the right to revoke the Participant’s eligibility for the said prizes.

By participating in the Promotion, Participants agree to be bound by these Terms and Conditions and Organizer’s decisions are final and binding. No correspondence or appeals will be entertained. Organizer reserves the right to the final and ultimate interpretation of this Promotion.

In accepting the Prizes, the winner(s) agree to participate and cooperate as required in all editorial activities relating to the Promotion. The Participants agree to grant Organizer a perpetual and non-exclusive license to use such footage and photographs, voice, biographical information and/or statements, at any time or times, in all media types worldwide for advertising, trade, publicity and promotional purposes and the Participants will not be entitled to any fee for such use.

Organizer assumes no responsibility for late entries due to any reasons including, but not limited to, network transmission failure.

Organizer shall not be responsible for any losses or damages directly or indirectly incurred by any party including the Participant in connection to or arising from acts or omissions or in any way related to this Promotion.

The Participant agrees to discharge and release Organizer from any liabilities and claims (including from breach of contract, tort, negligence or any other cause of actions at law or equity) arising out of or in any way connected to this Promotion or to the Participant’s entry in the Promotion.

The Participant further agrees to discharge and release any third party which is related to and connected with this Promotion, including Facebook, from any liabilities and claims (including from breach of contract, tort, negligence or any other cause of actions at law or equity) arising out of or in any way connected to this Promotion or to the Participant’s entry in the Promotion.

By entering into this Promotion, the Participant agrees to indemnify and hold Organizer and the Organizer Group of Companies, their officers, directors, shareholders, predecessors, successors in title, employees, agents and representatives harmless from any claims, losses, damages, liability, claims or expenses (including any legal fees), suffered or incurred by Organizer due to or in any way arising from this Promotion.

If Participants are discovered to be using or have used improper means to participate in this Promotion, Organizer reserves the right to cancel the eligibility without notice including without hesitation, the commencement of legal proceedings under the full extent of the applicable laws.

This Promotion and the Terms and Conditions herein shall be governed by the laws of the Philippines.
