Huawei Vision Onsite Service User Agreement

        The following clauses are legally binding agreements between you and
            Huawei Technologies Phils. Inc.. This Agreement establishes your rights and legal liabilities when using the
            Huawei Vision Onsite Service (hereinafter collectively referred to as the "Service"). In this Agreement,
            "You" means any individual who uses and accesses the Huawei Vision Onsite Service.
        Please read and fully understand the terms and conditions of this
            Agreement, especially those related to exemption or limitation of liability, application of laws, and
            dispute resolution. Important contents, such as exemption or limitation of liability clauses, will be
            highlighted in bold and should be read. If you do not accept all the terms of this Agreement, you are
            requested to stop using this Service. Your use will be deemed to be your agreement to be bound by this
            Agreement.
        1. Requirements for Using the Service
        You expressly represent and warrant that you have the appropriate legal
            rights to execute and perform this Agreement; Your execution and performance of this Agreement will not
            conflict with or result in a breach of any other agreement you are required to perform. Once you agree to
            and accept this Agreement, this Agreement shall be binding upon you and enforceable when necessary.
        2. About the Service
        (1) Basic services and functions
        Huawei Vision on-site service: Users who have purchased Huawei Vision
            products can call Huawei's after-sales service hotline or submit an on-site service application on Huawei's
            official website. After the service is accepted, Huawei will arrange service engineers to provide on-site
            service.
        This software provides services for Huawei terminal consumers in
            Philippines territory.
        (2) Availability
        With this service, you do not need to register and log in to your Huawei
            ID to place an order with one click.
        Huawei always adheres to the principle of consumer first. However, due to
            objective reasons, Huawei cannot guarantee that all services will run properly or be free from defects at
            any time. The Service may not be available in certain countries or regions due to the lack of the necessary
            environment and conditions for the provision of the Service. For example, online mail-in and
            appointment-to-store services may not function properly in some countries and regions. Huawei has the right
            to modify, delete, restrict, block access, and stop providing some or all of the Services without notice,
            based on its reasonable consideration and choice.
        3. Privacy Statement
        (1) Privacy and data collection
        To provide you with more stable services and ensure your transaction
            security, Huawei will collect and process your personal information in accordance with the privacy statement
            of this service.
        4. Intellectual Property Claims
        Service and contents provided by Huawei during the service process
            (including but not limited to web pages, text, images, audio, video, and commercial logos) The intellectual
            property rights of are owned by Huawei and its affiliates. The above intellectual property rights are
            protected by law. You promise not to use or create related content or derivative works in any form without
            the written permission of Huawei or the relevant rights holders.
        5. Exemption Clauses
        Huawei makes no representations or warranties, express or implied,
            including but not limited to merchantability, commercial ability, specific use, or non-infringement of any
            rights. Huawei makes no warranties in the following situations:
        (1) The Service will meet your specific needs;
        (2) The Service will be provided uninterrupted, timely, safe, or free
            from defects;
        (3) Any information obtained by you during the use of the Service is
            accurate or reliable;
        (4) Any defects or errors in the software that is part of the Service
            will be corrected.
        Huawei cannot guarantee that all services will work properly or be free
            from defects at any time and in any country or region. The Service may not be available in certain countries
            or regions due to the lack of the necessary environment and conditions for the provision of the Service.
            Huawei has the right to modify, delete, or stop providing all or any part of the Services based on its
            reasonable consideration and choice.
        Huawei has no control over your network operator and cannot provide any
            guarantee regarding the network coverage, availability, or quality of service provided by your network
            operator. You bear the risks of all content and other materials downloaded, obtained or accessed through the
            Service, as well as the risks of device and data damage and content loss caused by your use of the Service
            or third-party services. When using the Service, you shall comply with all relevant laws and regulations.
        
        6. Termination and Change
        In the event that the Service has to be terminated or changed due to the
            enactment or amendment of laws, binding regulations issued by relevant departments, or changes in Huawei's
            business direction, Huawei will notify the user through service announcements or short messages.
        Huawei reserves the right to amend this Agreement from time to time and
            replace the original Agreement in light of changes in national laws and regulations and business operation
            requirements. Users can log in to view the latest protocols at any time. Users are obligated to follow and
            read the latest version of the Agreement and website announcements from time to time. If the user does not
            agree to the updated agreement, the user shall immediately stop accepting the service. If the user continues
            to use it, it is deemed that the user agrees to the updated agreement.
        7. Liability for breach of contract
        You promise not to use the Service to violate national laws and
            regulations or violate the legal rights of third parties. If you cause losses to Huawei due to violations of
            national laws and regulations or this Agreement, you shall indemnify Huawei for any losses incurred and
            eliminate the impact.
        In any case, Huawei's total liability for breach of contract under this
            Agreement shall not exceed the total amount of service fees Huawei receives from you for providing this
            service.
        8. Force Majeure
        Huawei and its employees, agents, or subcontractors shall not be liable
            for the consequences of failure to perform, delay in performance, or performance of any other obligations
            under this Agreement resulting from events beyond their reasonable control. Force majeure events include but
            are not limited to:
        (1) Natural disasters, such as typhoons, earthquakes, floods, and
            hailstorms;
        (2) Governmental acts. such as expropriation, expropriation, amendment
            and enactment of laws;
        (3) Abnormal social events. such as war, strike, riot;
        (4) Service interruption caused by computer virus or hacker attack,
            Internet, communication line, etc.;
        If the event of force majeure continues, Huawei has the right to suspend
            performance of any of its obligations under this Agreement and to continue performance after a certain
            buffer period. Huawei will make reasonable efforts to end the Force Majeure event or find a solution so that
            Huawei can still fulfill Huawei's obligations even if the Force Majeure event continues.
        9. Applicable law and jurisdiction
        This Agreement shall be interpreted and governed by the laws of the
            People's Republic of China without regard to conflicts of laws.
        This Agreement is signed in 53rd Floor, PbCom Tower, Ayala Avenue, corner
            Rufino Street, Makati City. In case of any dispute arising from the contents of this Agreement or its
            execution, both parties shall try their best to resolve it through friendly negotiation. If negotiation
            fails, either party may bring a lawsuit to the people's court having jurisdiction in the place where the
            agreement is signed.
        10. Others
        You shall comply with all applicable laws in the performance of this
            Agreement.
        If any part of this Agreement is deemed to be invalid for any reason,
            such invalidity shall not affect the validity of other provisions.
        Huawei Technologies Phils. Inc. has the right to assign any rights or
            obligations under this Agreement.
        All headings in this Agreement are for ease of reading only and do not
            affect the meaning or interpretation of any part of this Service Agreement.
