Device Upgrade Premium Service

1. Introduction

1.1 Device Upgrade Premium Service (“Promotion”) is organized and managed by HUAWEI Technologies Africa (Pty) Ltd (“HUAWEI”), including affiliates and subsidiaries (collectively referred to as the “Organizers”).

1.2 The Promotion is open for entry by all South African residents of 18 years and older with a valid South African identity document or Smart Card.

1.3 By entering the Promotion, all Participants agree to be bound by these terms and conditions, which will be interpreted by the Organizers and the Organizers decision regarding any issue will be final and binding and no correspondence will be entered.

1.4 This Promotion will run from August 1st, 2023 – December 31st, 2023, (both dates inclusive) (the “Promotion Period”).

1.5 The Promotion deals exclusively with HUAWEI Service Center Menlyn Park Mall, HUAWEI Service Center Canal Walk, HUAWEI Service Center Cornubia Mall, SSS Cellular (ASC-E – Accredited Service Centre).

2. Trade In Process

2.1 All brands will be accepted (Original Products only)

2.2 Payment of the new device must be done before the Trade in process can be carried out.

2.3 Participants can upgrade their device if:

a. Only mobile phones qualify for this Promotion and exclude watches, bands and/or HUAWEI tablets.

b. Old devices are genuine regardless of the country it was purchased it from. (Not tampered with).

c. Old devices do not lack any original spare parts, such as cameras and screen (Excluding accessories, chargers & earphones).

d. No Unauthorized parts or any 3rd party workmanship carried out for previous repairs.

2.4 Upon purchase of the new device, the old device needs to be handed over to the (Participating ASC-E) for assessment.

2.5 ASC-E-E will arrange assessment which can take up to 3(three) business days from date of inspection.

2.6 Once the assessment is completed cash back amount will be calculated and issued.

2.7 Cash back will be paid via EFT to the Participants given bank account which can take up to 3(three) business days to clear.

2.8 Once cash back is transferred, the Participants old device cannot be returned and or accessed by the Participant and will become the property of the Organiser.

3. Participating Models for Purchase

3.1 The Organiser will provide a 12-month warranty for new devices.

3.2 Purchase is subject to availability (while stocks last).

3.3 Installment payment method is only available for:

HUAWEI Y9a, HUAWEI nova 8i, HUAWEI P50 Pocket & HUAWEI P50 Pocket Premium Edition. Installment period & Amount will be provided by the ASC-E.

3.4 Cash payment method is only available for HUAWEI nova 8 & HUAWEI nova 9.

4. Refund & Replacement Process

4.1 If the new device has been deemed as an OBF (Out of box failure, manufacturing issues, Excluding liquid & physical damage) and reported within 30 days of purchase a replacement will be issued.

4.2 Replacement devices will only be issued, once device has been declare faulty by an authorized HUAWEI Service Centre.

5. General Terms and Conditions

5.1 The Promotion is valid for the August, 1st, 2023 – December 31st, 2023

5.2 The Promotion Period may be extended or reduced at the discretion of the Organisers.

5.3 The Promotion, and any terms and/or conditions surrounding it may be amended by reasonable notification at any time and will be applied and interpreted in the sole discretion of the Organisers. Such altered terms and conditions shall become effective immediately after being altered or on such date as may be determined by the Organisers. No Promotion Participants shall have any recourse against the Organisers as a result of any alterations of the terms and conditions.

5.4 The Organisers reserve the right to extend, reasonably shorten or suspend the time period of the Promotion for technical or commercial or operational reasons or for the greater public good or due to a “force majeure” event or generally for any reason whatsoever within their sole discretion, on condition that the Organisers notify the Promotion Participants in a manner that is expedient according to its best ability.

5.5 The Promotion, any terms and/or conditions surrounding it may be amended by reasonable notification at any time during the Promotion, and will be applied and interpreted in the sole discretion of the Organisers. Such altered terms and conditions shall become effective immediately after being altered or on such date as may be determined by the Organisers. No Promotion Participants shall have any recourse against the Organisers as a result of any alterations of the Terms and Conditions.

5.6 The Organisers reserve the right to amend the rules and/or terminate this Promotion immediately at any stage, whether required as a result of changes in legislation, or if required by any national, provincial or municipal authority, or within the sole discretion of the Organisers for any reason (recognized in law). Notice of such termination shall be published on the Organisers Promotions Website. In such event, all Participants waive any rights that they may have/purport to have in terms of this Promotion and acknowledge that they will have no recourse against the Organisers whatsoever.

5.7 In the event of a dispute in regard to any aspect of the Promotion and/or the Terms and Conditions, the Organiser’s decision will be final and binding and no correspondence will be entered into.

5.8 All Promotion Participants indemnify the Organisers, their associated and subsidiary companies, and their directors, officers and employees, against any and all claims for any loss or damages, whether direct, indirect, consequential or otherwise, arising from any cause whatsoever from the Promotion Participants participation in any way whatsoever in this Promotion.

5.10 South African law shall govern these Promotion rules and the courts of South Africa shall have exclusive jurisdiction.
